1. About this Policy

Nuxovia Solutions Inc., doing business as Kouloo (“Kouloo”, “we”, “us”, or “our”), respects your privacy and is committed to protecting your Personal Information.

This Privacy & Cookies Policy explains how we collect, use, disclose, retain, protect, and otherwise process Personal Information when you use the Kouloo mobile application or our websites.

This Policy is intended to explain our privacy practices in clear and simple terms and to provide information required under applicable privacy laws, including Québec’s Act respecting the protection of personal information in the private sector, as amended by Law 25.

2. Definitions

For purposes of this Policy:

“Personal Information” means information about an identifiable individual.
“Processing” means any operation performed on Personal Information, including collection, use, disclosure, storage, or deletion.
“Child” means a person under 14 years of age.
“Consent” means a valid consent that is voluntary, informed, specific, and given for the purposes identified at the time consent is requested.

Our Privacy Officer is responsible for overseeing Kouloo’s privacy practices and responding to privacy-related questions, requests, and complaints.

4. Personal Information We Collect

Depending on how you use Kouloo, we may collect the following categories of Personal Information.

Account and authentication information

First and last name
Email address
Username
Password or authentication information
Telephone or mobile number

Profile information

Profile information you choose to provide
Profile photo, if you choose to upload one
Relationships or links between users and children

Child-related information

When provided by a parent or authorized guardian, Kouloo may collect:

Child’s first and last name
Child’s childcare service
Group or classroom information
Child’s photo, if provided
Information necessary to coordinate the child’s pickup

Child-related information is collected and used only for purposes connected with providing the Kouloo service and related operational functions.

Kouloo does not knowingly allow children under 14 to create their own accounts.

Location information

Location information is optional and is collected only when you activate a location-based feature and grant the required permission on your device.

Depending on the feature you use, location information may be used to:

estimate your arrival time;
account for traffic conditions;
support pickup coordination;
determine when you are approaching a designated pickup or preparation area; and
trigger operational notifications to the applicable childcare service.

Kouloo requests access to location information only when necessary for an enabled feature. You can manage or withdraw location permissions through your device settings, although doing so may prevent certain location-based features from functioning.

If a feature uses background location, we will explain this before requesting the applicable permission.

Device and technical information

We may automatically collect technical information such as:

IP address;
device type and model;
operating system and version;
language and region settings;
application version;
timestamps;
crash reports;
diagnostic information; and
technical logs required for security, troubleshooting, and service operation.

Cookies, SDKs and similar technologies

We use cookies, software development kits (“SDKs”), and similar technologies as described in Section 11 of this Policy.

We limit our collection of Personal Information to information that is reasonably necessary for the purposes described in this Policy.

5. Why We Collect and Use Personal Information

We may collect and use Personal Information for the following purposes:

creating and managing user accounts;
authenticating users;
verifying relationships between users and childcare services;
validating child enrollment where applicable;
providing pickup coordination and related Kouloo features;
calculating estimated arrival times;
providing location-based features when enabled;
sending operational notifications;
providing customer support;
maintaining and improving the security of our services;
preventing fraud, abuse, and unauthorized access;
diagnosing errors and improving application performance;
analyzing usage and improving the Kouloo experience, where permitted;
complying with legal and regulatory obligations; and
responding to privacy requests, complaints, and other legal requests.

We do not use Personal Information for purposes that are incompatible with the purposes for which it was collected unless permitted by law or we obtain the required consent.

Where consent is required, we request consent for the specific purpose for which it is needed.

6. Consent and Your Choices

Where required by law, Kouloo obtains consent before collecting, using, or disclosing Personal Information for purposes requiring consent.

Consent requests are presented separately and in clear language where required.

You may withdraw consent for optional processing at any time, subject to legal or contractual limitations and any consequences explained when consent is withdrawn.

For example, you may:

disable location permissions through your device settings;
manage optional cookies through our cookie settings;
manage certain application permissions through your device settings; or
contact our Privacy Officer to withdraw consent where applicable.

Withdrawal of consent does not affect processing that occurred before the withdrawal.

7. Children’s Information

Kouloo is designed for use by adults, including parents and authorized guardians.

Children under 14 are not permitted to create their own Kouloo accounts.

Information about a child may be provided by a parent, guardian, or other authorized person for the purpose of using Kouloo’s pickup coordination services.

We apply safeguards appropriate to the sensitivity of children’s information, including access controls, security measures, and restrictions on disclosure.

We do not knowingly collect Personal Information directly from children under 14 except where permitted by applicable law.

8. How We Share Personal Information

Kouloo does not sell Personal Information.

We may disclose limited Personal Information to service providers that perform services on our behalf, such as:

cloud hosting and infrastructure;
authentication;
mapping and location services;
application performance monitoring;
analytics;
push notifications;
customer support;
cybersecurity and fraud prevention; and
other technical services required to operate Kouloo.

Service providers are permitted to access Personal Information only as necessary to provide their services to Kouloo and are subject to contractual obligations concerning confidentiality, security, and the protection of Personal Information.

We may also disclose Personal Information where required or permitted by applicable law, including to comply with legal obligations, court orders, or lawful requests from authorities.

We do not share Personal Information with third parties for their own advertising or marketing purposes.

9. Third-Party Service Providers

Kouloo may use third-party technology providers to operate certain features of the application and website.

Where applicable, we will identify the principal third-party providers, the services they provide, and the categories of Personal Information they may process.

Some third-party providers may process information outside Québec or Canada. Where required by applicable law, Kouloo conducts the appropriate privacy assessment before communicating Personal Information outside Québec and implements appropriate contractual and security safeguards.

10. International Transfers

Kouloo currently intends to store and process Personal Information in Canada.

If Personal Information is communicated outside Québec, Kouloo will conduct an assessment of the applicable privacy factors where required by law, including the legal framework applicable in the destination jurisdiction and the safeguards available to protect the information.

Where required, Kouloo will enter into appropriate contractual arrangements and take reasonable measures to ensure that the Personal Information receives adequate protection.

We will provide any notices required by applicable law.

11. Cookies, SDKs and Similar Technologies

Kouloo uses cookies, SDKs, and similar technologies on its website and mobile application.

These technologies may be used to:

operate and secure our services;
maintain user sessions;
remember essential preferences;
measure application and website performance;
detect errors;
understand how our services are used; and
improve the Kouloo experience.

Essential technologies

Some cookies and similar technologies are necessary for the operation, security, and functionality of our services.

These technologies may include those used to:

keep you signed in;
maintain your session;
protect against fraud and unauthorized access;
remember essential preferences; and
provide features you have requested.

Because these technologies are necessary for the service, they may not be available for opt-out.

Optional analytics technologies

Where required by applicable law, Kouloo requests your consent before using optional technologies for analytics or other non-essential purposes.

These technologies may help us understand:

how visitors use our website;
which features are used;
how the application performs;
where errors occur; and
how we can improve Kouloo.

You may withdraw consent to optional technologies through our cookie settings or applicable privacy settings.

Mobile SDKs

The Kouloo application may use SDKs and similar technologies for application functionality, security, diagnostics, performance monitoring, error detection, and analytics.

Location services are separate from analytics technologies. Location information is collected only when the relevant location-based feature is enabled and the required device permission has been granted.

Advertising

Kouloo does not sell Personal Information and does not use cookies or similar technologies to sell Personal Information to advertisers or to provide third-party behavioral advertising.

If this practice changes, we will update this Policy and obtain any consent required by applicable law.

12. Privacy by Default

Kouloo is designed to apply privacy-protective settings by default where required by applicable law.

Optional privacy-invasive features, including location-based functionality, are not enabled unless the applicable feature requires activation and the required device permission has been granted.

13. Retention and Deletion

Kouloo retains Personal Information only for as long as reasonably necessary to fulfill the purposes described in this Policy, provide the service, meet legal obligations, resolve disputes, maintain security, and enforce our agreements.

When Personal Information is no longer required, we securely delete, destroy, or anonymize it in accordance with our retention and destruction practices.

Following account closure, certain information may remain temporarily in backups, security logs, audit records, or other systems where deletion is not immediately practical. Such information will be deleted or anonymized in accordance with our applicable retention periods.

You may contact our Privacy Officer for additional information about our retention criteria.

14. Security

Kouloo uses administrative, technical, and physical safeguards appropriate to the sensitivity and risks associated with Personal Information.

These safeguards may include:

encryption in transit and at rest where appropriate;
access controls;
role-based permissions;
privileged-account management;
secure authentication;
network and infrastructure security;
monitoring and logging;
secure key management; and
secure deletion or destruction.

No security measure can guarantee absolute security. Kouloo continuously evaluates and improves its security measures based on identified risks.

15. Privacy Incidents

Kouloo maintains procedures for identifying, assessing, containing, documenting, and responding to confidentiality incidents involving Personal Information.

We maintain a register of confidentiality incidents as required by applicable law.

If a confidentiality incident presents a risk that serious harm may result, Kouloo will notify the Commission d’accès à l’information and affected individuals as required by law and will take reasonable measures to reduce the risk of harm.

16. Automated Decision-Making and Profiling

Kouloo does not currently use automated decision-making or profiling that produces decisions with significant effects on individuals.

If we introduce such functionality, we will provide the notices and rights required by applicable law, including information about the decision-making process and, where applicable, a mechanism to request human review or contest the decision.

17. Your Privacy Rights

Subject to applicable law, you may have the right to:

request access to your Personal Information;
request correction of inaccurate or incomplete information;
withdraw consent for optional processing;
request portability of certain Personal Information in a structured format;
request cessation of dissemination or de-indexation in applicable circumstances; and
make a complaint regarding our handling of Personal Information.

You may exercise your rights by contacting our Privacy Officer.

We will respond to privacy requests within the time limits required by applicable law.

18. Privacy Complaints

If you have a concern or complaint about the handling of your Personal Information, we encourage you to contact our Privacy Officer first so that we can investigate and attempt to resolve the matter.

You may also file a complaint with the Commission d’accès à l’information du Québec where permitted by law.

19. Changes to this Policy

We may update this Privacy & Cookies Policy from time to time to reflect changes to our services, technologies, legal requirements, or privacy practices.

When changes are material, we will provide notice through the Kouloo application, website, or another appropriate means before or when the changes take effect, as required by law.

The “Last updated” date at the beginning of this Policy will be updated whenever the Policy is revised.
